Terms of Service

1. Services Offered

• VelocityNodes provides game server hosting, web hosting (including shared hosting, email hosting, and WordPress hosting), Discord bot hosting, and custom development (e.g., Minecraft plugins, server setup).
• Our primary server infrastructure is located in South Africa, and services are delivered globally subject to availability.
• We reserve the right to modify, suspend, or discontinue services at any time, with or without notice.

2. Account Registration & Use

• You must provide accurate account information and keep credentials secure.
• You are responsible for all activity under your account.
• We are not liable for loss or damage arising from unauthorized access to your account.
• We may suspend or terminate your account for violation of these Terms.

3. Billing and Payment

• All services are billed in United States Dollars (USD).
• Services are billed monthly in advance and must be paid for before activation.
• Non-payment results in suspension or termination of services.
• Chargebacks or payment disputes will result in immediate account suspension.
• All prices are subject to change with notice.

4. Refunds

• A full refund is available if requested within 24 hours of purchase.
• No refunds are provided on domain purchases, licenses, or completed custom work.
• Refunds are issued to the original payment method unless stated otherwise.
• To request a refund, you must open a ticket at https://billing.velocitynodes.com/tickets.

5. Acceptable Use Policy (AUP)

You agree not to use our services for:

• Illegal activities (including but not limited to DDoS attacks, malware, fraud, phishing, spamming).
• Hosting or distributing content that violates copyright, trademarks, or intellectual property laws.
• Hosting or sharing copyrighted or pirated content.
• Sending spam or bulk unsolicited emails.
• Running scripts, software, or processes that excessively consume system resources and negatively impact server performance or other customers.
• Hosting prohibited web content, including phishing sites, child exploitation material, scams, or obscene content not permitted by law or platform policy.
• Any activity that violates the laws of South Africa (our server location) or your own local jurisdiction.

We reserve the right to investigate and take immediate action (including suspension or termination) if we believe you are violating this AUP. No refunds will be issued in such cases.

6. Custom Services

• Custom work (such as plugin creation, server setup, Skript creation, and Discord bot creation) is quoted on a case-by-case basis and may incur additional charges depending on complexity.
• We may decline custom work at our discretion.
• We do not provide Minecraft builds, premium plugins, or paid assets as part of any service unless you provide a valid license.
• All custom work is subject to review and approval.

7. Web Hosting Terms

• You are responsible for your website content, email configuration, and database management.
• All hosting plans are subject to fair usage policies. Excessive bandwidth, CPU, or disk use may result in throttling, additional fees, or suspension.
• Web hosting services may not be used for file storage, file distribution, or offsite backups.
• We reserve the right to suspend any site that impacts service stability for other customers.

8. Data & Backups

• VelocityNodes does not guarantee the integrity or availability of your data.
• Customers are responsible for maintaining their own backups.
• Website, email, and database content may be deleted upon termination or failure to renew services.

9. Service Availability

• We aim for 99.9% uptime (see our SLA for details).
• Downtime may occur due to scheduled maintenance, upgrades, or emergencies.
• We are not liable for damages caused by downtime, service interruptions, hardware/software failures, or other technical issues.

10. Support

• Support is provided through our ticket system at https://billing.velocitynodes.com/tickets.
• Support is limited to issues directly related to our services and infrastructure.
• We do not provide support for third-party applications, custom software, customer scripts, or external configurations unless explicitly stated.

11. Termination

• You may cancel your services at any time through the client portal.
• We may terminate your account or services at our discretion for violations, non-payment, or abuse.
• Upon termination, all data associated with your services may be permanently deleted.

12. Limitation of Liability

• VelocityNodes is not responsible for any damages, data loss, downtime, or financial loss caused by the use or inability to use our services.
• Our maximum liability is strictly limited to the amount paid for the service in the month the issue occurred.

13. Modifications to Terms

• We may update these Terms at any time.
• Continued use of our services after updates constitutes acceptance of the revised Terms.
• We will notify you of material changes via ticket or client portal.

14. Governing Law

• These Terms shall be governed by the laws of South Africa, where VelocityNodes is operated, and any disputes shall be subject to its jurisdiction.
• Customers must comply with applicable laws in their own jurisdiction. These Terms and any disputes shall be governed by the laws of South Africa.
